These Terms and Conditions govern the sale and supply of products by MonsterWhip (“we”, “us”, “our”), operated from Luxembourg, through the website monsterwhip.com. By placing an order, you agree to these terms.
1. Products & Orders
All products sold by MonsterWhip are food-grade N2O (E942) cream chargers intended exclusively for legitimate food preparation use by registered food businesses. We reserve the right to refuse or cancel any order at our discretion.
2. Minimum Order Quantity
All wholesale orders are subject to a minimum order quantity (MOQ). The current minimum order requirement will be communicated at the time of quotation. MonsterWhip reserves the right to adjust minimum order quantities at any time. Orders below the stated minimum may not be processed.
3. Pricing & Payment
All prices are quoted in EUR unless otherwise agreed. Prices are exclusive of VAT unless stated otherwise. VAT-exempt invoicing is available for registered EU businesses with a valid intra-community VAT number. Payment terms will be specified on your invoice. MonsterWhip reserves the right to change prices without prior notice. Price changes do not affect orders already confirmed.
4. Shipping & Delivery
MonsterWhip ships from Luxembourg. Estimated delivery times are provided as guidance and are not guaranteed. We are not liable for delays caused by carriers, customs, or circumstances beyond our control. Risk of loss passes to the buyer upon handover to the carrier. N2O is classified as a pressurized gas for shipping purposes — all shipments comply with applicable dangerous goods regulations.
5. Returns & Refunds
Due to the nature of pressurized gas products, returns are only accepted for defective or damaged goods. Any damage must be reported within 48 hours of delivery with photographic evidence. Refunds or replacements for confirmed defective products will be processed at our discretion. Opened or used products cannot be returned.
6. Product Use & Compliance
Our products are sold exclusively for food preparation purposes by registered food businesses. The buyer is responsible for ensuring compliance with all local, national, and international regulations regarding the purchase, storage, and use of N2O in their jurisdiction. MonsterWhip is not liable for any misuse of its products.
7. Limitation of Liability
To the maximum extent permitted by law, MonsterWhip shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our total liability shall not exceed the value of the order in question.
8. Intellectual Property
All content on monsterwhip.com — including text, images, logos, and branding — is the property of MonsterWhip and may not be reproduced without written permission.
9. Privacy
We collect and process personal data in accordance with applicable data protection laws including the EU General Data Protection Regulation (GDPR). Business contact information provided during ordering is used solely for order processing, delivery, and customer communication.
10. Governing Law
These Terms and Conditions are governed by the laws of Luxembourg. Any disputes shall be subject to the exclusive jurisdiction of the courts of Luxembourg.
11. Changes to Terms
MonsterWhip reserves the right to update these Terms and Conditions at any time. The current version will always be available on this page. Continued use of our services after changes constitutes acceptance of the updated terms.
